Case Description
Theseo Mallis, hating the late Ser Augustino di Augustini, citizen of this city [of Brescia] because he [Augustino] was trying to recover a certain debt he had with Monsignor Mallo for goods given to him to free this Theseo and finally, resolved through such impious hate and unjust cause to take his life knowing that the said late Ser Augustino, on the evening of Wednesday, January 24th last past, found himself—as was his habit—playing cards and gambling in the house of some gentlemen Canoli...at two hours of the night, having waited for him in the district of San Alessandro near the house of Ser Gierolamo Mainalla through where returning to his house, it was necessary for him to pass; they assaulted him, firing against him two arquebus shots, and with said they killed him committing such a grave and impious homicide, knowingly, deceitfully, premeditatedly, and lying in wait with wearing masks, and carrying and firing of arquebuses which were also prohibited
